1. About Upcartt

Upcartt is an online marketplace platform that connects buyers and independent creators/sellers offering handmade, custom, art, DIY, and unique products.
Upcartt does not sell products, does not process payments, and does not handle shipping.

Upcartt acts solely as a facilitator of communication between buyers and sellers.

 
2. Eligibility

To use Upcartt:

  • You must provide accurate and truthful information

  • You must comply with all applicable local, national, and international laws, including laws of Pakistan

We reserve the right to suspend or terminate accounts that violate these Terms.

 
3. User Accounts
3.1 Account Responsibility

  • You are responsible for maintaining the confidentiality of your account

  • Any activity under your account is your responsibility

3.2 Account Suspension or Termination

Upcartt may suspend or terminate accounts if:

  • False or misleading information is provided

  • There are repeated complaints or policy violations

  • Fraudulent, abusive, or illegal activity is detected

 
4. Role of Buyers and Sellers
4.1 Sellers

Sellers are solely responsible for:

  • Product descriptions and accuracy

  • Pricing

  • Customization details

  • Shipping methods, timelines, and costs

  • Communication with buyers

  • Compliance with applicable laws

4.2 Buyers

Buyers are responsible for:

  • Reviewing product details carefully

  • Communicating clearly with sellers

  • Agreeing on price, customization, and shipping terms before purchase

 
5. Payments

⚠ IMPORTANT PAYMENT DISCLAIMER

  • Upcartt does NOT process payments

  • Upcartt does NOT collect commissions through checkout

  • All payments are made directly between buyer and seller

  • Payment methods and terms are decided independently by both parties

Upcartt is not responsible for:

  • Payment disputes

  • Payment failures

  • Refunds

  • Chargebacks

  • Fraud related to payments

 
6. Shipping & Delivery

  • Shipping arrangements are entirely negotiated between buyer and seller

  • Upcartt does not arrange, manage, or guarantee shipping

  • Delivery times, methods, and costs may vary by seller

Upcartt is not responsible for:

  • Delayed deliveries

  • Lost packages

  • Customs issues

  • Damaged items during transit

 

7. Product Quality & Liability

  • Products listed on Upcartt are handmade or custom, and variations are expected

  • Upcartt does not guarantee product quality, durability, or fitness for purpose

Upcartt is not liable for:

  • Defects

  • Damages

  • Misrepresentation by sellers

  • Dissatisfaction with final products

 
8. Complaints & Dispute Handling
8.1 Buyer Complaints

Buyers may submit complaints regarding sellers through Upcartt’s support system.

8.2 Platform Action

While Upcartt does not intervene in transactions, we may:

  • Review complaint history

  • Issue warnings

  • Temporarily suspend seller accounts

  • Permanently ban sellers with repeated or serious violations

Upcartt’s actions are administrative only and do not constitute legal judgments.

 
9. Prohibited Activities

Users may NOT:

  • Post illegal, offensive, or misleading content

  • Sell prohibited or restricted items

  • Impersonate another person or business

  • Harass, threaten, or abuse other users

  • Use the platform for unlawful purposes

Violation may result in immediate account termination.

 

10. Intellectual Property

  • Sellers retain ownership of their content and creations

  • By listing content on Upcartt, sellers grant Upcartt a non-exclusive license to display and promote listings

  • Users may not copy, reproduce, or redistribute content without permission

 
11. Privacy & Data Protection

Upcartt processes personal data in accordance with:

  • International privacy standards

12. Limitation of Liability

To the maximum extent permitted by law:

  • Upcartt shall not be liable for indirect, incidental, or consequential damages

  • Upcartt’s total liability shall not exceed the amount paid to Upcartt (if any)

 
13. Indemnification

You agree to indemnify and hold harmless Upcartt from:

  • Claims arising from your use of the Platform

  • Violations of these Terms

  • Disputes with other users

 

14. Modifications to Terms

Upcartt may update these Terms at any time.
Continued use of the Platform constitutes acceptance of revised Terms.
